DragonzGate Swim Spa - Waiver

Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement:  

PLEASE READ CAREFULLY. BY ATTESTING OR SIGNING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

Dragonzgate Swim Spa (Owner of Property, Hosts): Dragonzgate Swim Spa facility is for registered clients only, I recognize and fully understand certain things, including: 

• There is no lifeguard on duty, I am responsible for my safe conduct while using the swim spa and swim at my      own risk.
• I represent and warrant that I am in good physical condition, can swim or exercise in the swim spa independently, and have no physical, health-related or other problems which would be harmful to myself or others using the swim spa.
• The use of the swim spa is intended for individual adults only. I am over 18, I am responsible for my behavior and will adhere to all the rules of the property.  
• My use of the swim spa facilities involves certain risks, including but not limited to:

                    o The risk of injury from possible malfunction of the swim spa equipment.

                    o The risk of injuries resulting from tripping or falling in the swim spa area.

                    o The risk of other injuries resulting from use or any action in the swim spa.

I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming. 

I acknowledge and agree that: I have reasonably assessed the risks involved in using Dragonzgate Swim Spa and have made an informed and voluntary choice to participate. 

I alone, am responsible for determining my fitness for using Dragonzgate Swim Spa and my ability to fully understand any directions or warnings presented. I will not use Dragonzgate Swim Spa when I am aware or should reasonably be aware of any factors that may limit or prevent me from safely using it.
 

I acknowledge that that I am solely responsible for my own behavior and assume any risks in using the swim spa. I will act reasonably and responsibly and will comply with any provided and customary conditions, directions, and/or precautions for using Dragonzgate Swim Spa.  And I therefore hold harmless and indemnify Dragonzgate Swim Spa from any and all liability to property or personal injury resulting from the use of the swim spa or swim spa area.

I intend this Release and Waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that if any portion of this Waiver and Release is held to be invalid, the balance notwithstanding shall continue in full force and effect.
 

By signing this document, I affirm that I HAVE READ THIS RELEASE AND WAIVER AND FULLY UNDERSTAND THE ASSUMPTION OF RISK, RELEASE, WAIVER, AND CONSENT CONTAINED IN IT.  I FURTHER UNDERSTAND THAT I HAVE GIVEN UP RIGHTS BY AGREEING TO THESE TERMS, AND HAVE DONE SO FREELY AND VOLUNTARILY AND WITHOUT INDUCEMENT.
